Colchester Borough Council's response to the submissions by developers - including the industrial/housing site in School Road and alongside the A12 on pages 14-16.

 

 

 

There will be a meeting in the Community Centre,  Saturday 23rd January, 10.00 - 11.30.

 

The objective is to come up with a letter from the Parish Council to the Inspector that sums up the views of the Council and we would hope the Parish. Anyone who feels they could contribute to this will be welcome.

Exhibition at the Community Centre  Monday 30th November 6.00 - 9.00pm

 

Many in the village have received a leaflet inviting them to an exhibition in the Community Centre.

 

The exhibition will illustrate proposals made by the Whitnell Group and Powerplus Engineering concerning a proposal to develop an industrial site on the land alongside the A12, from Park Lane to Birchfield Road, and behind Wick Road.

Application no. 082024 – Jeveck, Chapel Road

 

This is a second application and we note that pre-application advice has been taken. In this case, we have no objections.

 

 

Application no. 082015 – 2, Perry Lane

 

We note that neighbouring dwellings are substantial and it is possible that the building line will be moved forward, in keeping with the neighbouring properties. Other than this observation, we have no reason to oppose this application.

 

 

Application no. 082008 – Fairlight, Moor Road

 

This application appears to be framed more as a normal application for planning approval than a Certificate of Lawfulness and we wonder why this is presented as a request for a Certificate of Lawfulness. The property footprint will change but there will be no change in height. Other than these comments we have no objections.

 

 

Application no. 081998 – Glebe House, Rectory Road

 

This application clearly seeks to upgrade and refurbish the existing storage facility in the former listed Coach House. This seems a necessary and desirable aim and the Parish Council has no objections.

 

 

Application no. 081991 – Nightingale Farm, Nightingale Hill

 

We note that this application is for renewal of existing approval given in 1998. We have some concern at the size of the conversion and its impact on the view from public places, namely Footpaths 20 and 22 and the highway. Other than these concerns, we have no objections.

Application  No 081818 - Jeveck, Chapel Road, Langham

 

Proposed poolside changing rooms

 

If we review this application in isolation the Parish Planning Committee would have to say that there is no major objection. However, we would like to register our concern that this is only part of a much larger project which would involve a swimming pool, possible housing and likely screening which could involve further site development and impact a number of material factors at a later stage. We therefore believe that it is unrealistic to consider this application in isolation from the overall project.

 

 

Application No 081813 - Land Adjacent to Jeveck, Chapel Road, Langham

 

Change of use from agriculture to private amenity land including minor realignment of driveway and landscaping scheme.

 

The Parish Council Planning Committee have reviewed this application and feel that it does not comply with sections CO1, CO8 and H12 of the Colchester Borough Local Plan which seeks to protect the countryside. We believe that this requested change involves the unnecessary sacrifice of good quality agricultural land. The application claims that the land is "Grade 3b quality at best" but we dispute this because the land has consistently produced good yields from a variety of crops. Last year we believe  the field was used for the commercial growing of onions which would not have been viable on land as poor as 3b. In our view this application also sets a precedent for similar applications in the vicinity.

 

We also have a major concern that several of the changes requested have already been carried out. This applies to the iron railings as a boundary treatment and the fact that the land has already been laid to lawn. This makes a part of the application retrospective. Furthermore, the requested driveway change is described as minor, we do not accept this as the new configuration takes up a significant part of the new land. In addition this change would constitute development work however the land is classified.

 

We therefore object to this application.

 

 

October 2008

 

Application no. 081595 – Serenity, High Street, Langham

 

We note that the current application is for the erection of a fixed structure on land which has received permission for Change of Use from agricultural to domestic garden, for which we would expect there to be conditions already in place. The property is also outside the Village Envelope.

 

We would, however, request that the proposed summerhouse be used solely for recreational purposes and not accommodation. Other than this concern, we have no objections.

 

 

Application no. 081485, Jeveck, Chapel Road – Retention of external staircase

 

Whilst the Parish Council sees no difficulties with this application, it would wish that approval should be conditional upon the retention of use of this part of the garage as an attic store and not for accommodation purposes.

 

 

Application no. 081418 – The Manse Dedham Road

 

The application is to replace a single garage with a double garage, with storage over.

The Parish Council notes that this is a larger structure than the rather modest one it replaces and is in the Dedham Vale Conservation Area, but it is well screened from this landscape by a substantial bank of trees, and is some distance from Dedham Road.

We would wish to make mention of the status of part of the property as a Methodist burial ground, and that the Vestry, immediately adjacent to the proposed build, has a baptismal chamber beneath the floor.

The Parish Council does not object to this application, but suggests that suitable conditions be applied to approval; that the Vestry is protected during the build, that access to the burial ground is maintained, and the new garage/storage building should not be turned into accommodation.

 

 

Application no. 081401 – Lawful Development Certificate for an Existing Use - Martin’s Farm Barn

 

The application is supported by a number of Statutory Declarations, both by the applicant and others, but no accounts of rent, etc.

The Parish Council notes that a number of residents have objected to this application, on the grounds of dangerous access to Dedham Road, and a site visit confirms this to be a narrow and windy section of road used by vehicles at some speed.  Sight lines are limited, as are manoeuvring options off the road.

The barn, upon inspection, does give rise to some concern as to its condition, with possible issues of vandalism, fire and theft, and especially as it concerns fire.

These issues concern local residents, as the site is remote from services and is considered vulnerable to anti-social behaviour and crime, and nearby timber structures are at risk from spreading fires.

The Parish Council opposes this application on the grounds that the position and condition of this building is unsuitable for the purpose of commercial storage, as the application has demonstrated is its present, unauthorised, function.

 

 

 

Application no. 081334 – Land adjacent to Old Thatched Cottage Ipswich Road

 

The site for this application is outside the Village Envelope and there is no justification for breaking the Village Envelope principles contained in the Local Plan. In addition, the Village Appraisal by Colchester Borough Council (April 1994), adopted as Supplementary Planning Guidance, stated (p 27 d)) of this specific area: “The cluster of houses and bungalows sited in the vicinity of the junction between Old Ipswich Road and Lodge Lane forms a sub-area considerably smaller in size than the 3 previously mentioned. None of these dwellings are of historical importance, however, many of them are layed (sic) out in spacious grounds. Infill development pertaining to these attractive gardens will not be looked upon favourably.”

 

We would also add that:

 

a)      This area  forms a “green break” of agricultural and garden land between Colchester and the village;

b)      There is an abundance of wildlife in the area;

c)       Noise pollution from the A12 trunk road is a significant issue;

d)      Approval would establish a precedent for applications for further development of this primarily agricultural area;

e)      No mains sewage or gas utilities are connected.

 

For the above reasons, Langham Parish Council objects very strongly to this application.

 

 

 

Application no. 081329 – Park Lane Farm Barns

 

No objections.

 

 

Application no. 081326 – Yew Tree Cottage

 

The current application appears to be a radical change to the previous application (F/COL/05/1403), in that the current plan now incorporates additional ground floor accommodation, as well as a first floor bedroom, consisting of a lounge/sitting area, kitchen, 2nd bedroom and shower room. Thus the building ceases to be a granny annexe dependent on the main house and becomes an independent dwelling. In addition the property is Grade II listed and we are concerned that this application may require Listed Building Consent. Any increase in the size of this proposed building over the size of the present garage will also have an impact on its aspect from Chapel Road. We therefore object to this application on these grounds.

The documentation for both applications appears identical although different numbers are attached. No objections.

 

 

Application no. 081067 2, Spencer's Piece

 

A small part of the proposed conservatory would be visible from School Road. No objections.

 

 

Application no. 081045 Dove House

 

This application for conservatory extensions, if approved, would significantly increase the glass area of the whole property and the ground floor extension would be visible from Langham Lane, thereby causing us some concern. This is outside the Village Envelope and an extension in materials other than glass would be an “extension in the countryside” and also would have contravened policy concerning unacceptable increases in perceived bulk when viewed from a public place. Other than these concerns, we see no other difficulties with this application.
